Restricted Land Use Notice

Apply For A Notice

If you are proposing development of property located in a vulnerable area where source protection plan policies apply, you need a Restricted Land Use Notice (Notice). Proposed development is anything that requires municipal approval of a:

  • Building permit
  • Planning Act application (e.g. zoning or official plan change, minor variance, severance, site plan or plan of subdivision)
  • Condominium Act application

To apply for a Notice, simply complete the online application through our Risk Management Office.

The Risk Management Official will review your application. They will identify potential drinking water threats and implement applicable source protection plan policies.

A Notice will be issued if:

  • No threats are identified that are prohibited or require a risk management plan; or,
  • A risk management plan is in effect.

A Notice will not be issued if:

  • A Threat is prohibited. In this case, the Risk Management Official will inform the applicant writing. They may also propose changes to the proposal to eliminate the threat so a Notice can be issued.

Once issued, the Notice will be emailed to the Applicant. The Notice must then be submitted to the municipality as part of the proposed development application. The municipality cannot approve the proposed development without it.

A Notice can typically be issued within 4-5 business days, often less. It may take longer if a risk management plan is required.

No, there is no fee to apply for a Restricted Land Use Notice.
