DRAFT Policy and Guidelines for Part VII: Enforcement and Offences

Why was an updated document required?

Otonabee Conservation updated its enforcement and offence guidelines to reflect regulatory changes under the Conservation Authorities Act. These legislative updates introduced new enforcement tools, including Stop Orders and modernized Powers of Entry.

The revised guidelines ensure staff conduct compliance and enforcement activities in a fair, consistent, and defensible manner. They promote transparency and provide clear direction for managing complex or high‑profile cases.

By following the principles of fairness, consistency, transparency and timeliness, staff can effectively carry out their duties under the Act while protecting public safety and the interests of watershed residents.

Education and Outreach

Education and outreach remain a priority, as increased awareness of regulations improves compliance.

Risk-Based Approach

Otonabee Conservation continues to apply a risk‑based approach to compliance. Where impacts are minor and compliance is likely, permitting after the fact may be appropriate. In cases involving significant impacts or public risk, stronger enforcement may be required due to the higher risk of non‑compliance through standard permitting processes.
